Prop-8 Ruling Partially Stayed 08/16/10 5pm TDH

An appeals court today blocked gay marriages from resuming in California, staying a decision made earlier this month that would have allowed them to proceed.   A federal judge had made 2-separate decisions in the prop-8 case.   First, Judge Walker ruled the proposition unconstitutional, and he then ruled that same-sex marriages can continue.   Supporters of Prop-8 appealed the decisions, and requested that the decision to allow marriages to continue to be blocked, until the case is decided in appeal.   Arguments are set for the week of December 6th, making a decision this year unlikely.   The panel of 3-judges asked both sides to prepare briefs, and asked supporters of the proposition to address the fact that both California’s governor and attorney general oppose enforcing the law.
