D.A.: Gavilan trustees did violate Brown Act 05/31/12 7:45p.m. TDH

The santa clara county district attorney has issued a letter of support, to allegations that members of the board of trustees for gavilan college violated a state law.   “The Brown Act” requires disclosures of certain agenda items involved in closed-door meetings by public agencies, and prevents salary raises at closed door meetings.  Officials with the League of United Latin American Citizens, known as LULAC, complained in mid-may that the meeting last October involved a pay increase for the board’s president, and that the move was not announced on the meeting’s agenda.  The santa clara district attorney has contacted representatives for the board of trustees.  A response from the board is expected soon.   In the meantime, the d-a noted that it is too late to force board members to reverse the pay increase, but legal action could be mitigated if the board changes the action.
