A second inmate convicted of murder in a 1991 home invasion in Salinas has been denied a resentencing hearing. Lester Polk has been serving time for the rape of a 17 year old and the murder of her father for his role in the home invasion. Polk had petitioned for resentencing after California changed the definition of murder. However, Judge Carrie Panetta ruled that Polk was a major participant and acted with reckless indifference to human life making him ineligible. Another inmate was denied resentencing for his role in the 1991 crime last month.
