Employee sues dole, overtime pay 01/04/13 11:45a.m. TDH

A lawsuit has been filed against dole food company, by a former employee.   Jose l. Hernandez accuses the company of denying overtime pay to him and other workers.  Hernandez’s complaint (on behalf of the plaintiffs) outlines his argument that the company was cheating workers out of pay, by having them suit-up and scrub-down while off the clock.   Hernandez said those and other activities necessary to the job take substantial amounts of time, and employees should be compensated.   Dole officials maintain that all regulations are being followed, and no laws have been broken.   The class-action lawsuit was filed with monterey superior court.      Hernandez is seeking unspecified back-pay for himself and similar employees.
