A mistrial was declared in court proceedings against 26 year old Damien Welch. Welch was shot 3 times by an Aptos resident in the early morning hours of June 20thas he tried to break into the home. The jury deadlocked after three days of deliberation on felony burglary charges. A retrial could be scheduled as early as today (Mon). Welch, who is out on bail is suing the the homeowner for civil damages related to the shooting.
