An appeals court has again sided with the pajaro valley water management agency, in a lawsuit filed by the agency’s director. John eiskamp had filed the suit in santa cruz county last year. He argued that an 80-dollar fee imposed by the agency in 2002 should be invalidated and refunded. A santa cruz county judge ruled for the agency, saying that a previous legal settlement covered that matter. This week, the 6th district court of appeals agreed with that judgment. That means that the agency will not have to refund more than 14-thousand dollars. the so-called “augmentation fee” has since been replaced with other voter approved fees.
