American flag t-shirt ruling 11/11/11 4p.m. TDH

A federal judge has ruled that morgan hill unified school district officials did have authority to force 3-students to change or conceal their t-shirts.   on may 5th 2010, the 3-live oak high school students were told by school officials to change or hide their shirts, which had American flags on them.    School officials were seeking to prevent fights over the clothing, which had occurred on past cinco de mayos.  The students filed suit against the district, arguing that their 1st amendment rights were violated.  However, u.s. district court judge james ware ruled that school officials did have the authority, given that they could “reasonably forecast” that “a substantial disruption” to student activities would occur.    The students plan to appeal to the decision.
