Legal concerns caused the tabling of proposal to increase the amount of notice landlords must give to tenants they are evicting. The emergency ordinance would have required 90 days’ notice.
The council voted unanimously on Tuesday to table the motion after the city attorney told them passage was likely to result in a lawsuit that the city would probably lose.
State law requires 30- or 60-days’ notice to tenants, depending on the cause of the eviction. City Attorney Tony Condotti told the council that the city cannot legally require notice longer than what is already required by state law.
