(18:17) SAN FRANCISCO & GILROY – A Gilroy man’s gang-related murder conviction has been overturned by a Federal Appeals Court. Paul Zapata was found guilty in 2004 of the First Degree Murder of 19 year-old Soledad resident Juan Trigueros in the parking lot of a Gilroy 7-11 store back in 2001. The 9th U-S Circuit Court Of Appeals ruled today that a Santa Clara County prosecutor made false, inflammatory, and ethnically charged remarks in his closing arguments on the 2004 trial of a Gilroy murder case. They also ruled that Zapata’s attorney’s failure to object to the those remarks constituted “ineffective assistance of counsel”.
