A Pajaro Valley water official is appealing a judge’s ruling to dismiss a lawsuit he filed challenging groundwater pumping fees. Pajaro Valley Water Management Agency Director, John Eiskamp, filed the lawsuit last August requesting an invalidation of a fee, that was imposed by the agency in 2002, while also ordering a refund of over $14,000. A Superior Court judge ruled in favor of the defendants in January, saying elected officials can NOT sue their own agencies over political decisions, and that the status of the fee had been decided in previous litigation.
